Abstract

The development of information and communication technology has driven the increasing use of social media as a means of communication and information exchange. However, these developments have also given rise to legal issues, one of which is the dissemination of personal data without the owner's consent, including in the form of memes that spread widely on social media. This study aims to analyze whether the dissemination of personal data in the form of memes can be qualified as personal data misuse, and to identify the forms of legal protection available to victims. This study employs a normative juridical method with a statutory approach through a literature review of primary, secondary, and tertiary legal materials. The results of the study indicate that the dissemination of personal data in the form of National Identity Card (KTP) photos as memes on social media can be qualified as personal data misuse, as it fulfills the elements of unlawful disclosure of another person's personal data as stipulated in Article 65 paragraph (2) of Law Number 27 of 2022 on Personal Data Protection. Legal protection for victims can be provided through preventive and repressive measures. Preventive protection is carried out through regulations governing the processing and use of personal data, while repressive protection is implemented through law enforcement in the form of criminal sanctions, administrative sanctions, and civil lawsuit remedies against perpetrators.
