Abstract
A child refers to any person below the age of 18 and is entitled to comprehensive legal safeguards against all types of violence, particularly sexual abuse. Despite these protections, incidents of child sexual abuse persist including those perpetrated by biological fathers. This study aims to examine the legal mechanisms available under Law Number 35 of 2014 and Islamic jurisprudence to protect children who experience sexual abuse by their biological fathers, as well as evaluate the role played by the Surakarta City Police in handling the case, specifically Case Number BP/38/IV/2022/RESKRIM. Adopting a legal-empirical methodology with a descriptive design, the study was carried out through fieldwork at the Surakarta City Police Department complemented by an analysis of relevant legal literature. Findings reveal that the Women and Children’s Service Unit (PPA) within the Surakarta City Police undertakes critical responsibilities, including conducting preliminary inquiries and formal investigations, while also ensuring continuous support and protective measures for the victim throughout the judicial process. From the standpoint of Islamic law, such offenses are classified as zina mahram, a severe transgression and warrant stringent legal and moral consequences to uphold the child’s inherent rights, dignity, and well-being.
