Abstract

This research aims to examine how copyright protection is implemented for Batik Saseti motifs in Indonesia and to identify the types of infringements that occur as well as the legal remedies available to the copyright owner. Batik Saseti was chosen as the object of study because it is one of the batik enterprises in Surakarta that has experienced motif plagiarism without the creator’s permission, resulting in both moral and economic losses for its artisans. This study uses a juridical-empirical approach, combining legal analysis with field observation. Primary data were obtained through interviews with the owners and artisans of Batik Saseti, while secondary data came from books, journals, and relevant legislation. The collected data were analyzed using a descriptive qualitative method to illustrate the actual implementation of copyright protection for batik motifs in practice. The results indicate that legal protection for Batik Saseti motifs is consistent with Law Number 28 of 2014 on Copyright, particularly through preventive measures such as the registration of works at the Directorate General of Intellectual Property. However, the implementation is not yet optimal due to high registration costs, weak law enforcement, and a low level of public awareness in respecting original creations. In conclusion, copyright protection for Batik Saseti motifs needs to be strengthened through cooperation between the government, batik entrepreneurs, and society to ensure that batik, as Indonesia’s cultural heritage, remains preserved and protected from plagiarism.
