Abstract

The development of Artificial Intelligence (AI) has given rise to new challenges in the protection of Intellectual Property Rights (IPR), particularly regarding the legal status of works produced by AI. This study aims to analyze the legal framework and policies in China in regulating IPR protection, particularly copyright protection for AI works, and to examine the challenges and development trends of its law enforcement through jurisprudential practice. This research is a normative-juridical legal research with a statutory approach. The legal materials used include primary, secondary, and tertiary legal materials with data collection techniques through literature studies. Data analysis is conducted descriptively by outlining the provisions of laws and regulations, legal concepts, and court decisions, then ending with drawing conclusions. The research findings indicate that China tends to adopt the principle of human-centered authorship, recognizing humans as the creators of works. Therefore, copyright protection for AI works remains dependent on the level of human involvement in the creation process. This study concludes that works entirely generated by AI do not receive copyright protection. However, works generated with real human contribution can still be protected. The main challenges in enforcing copyright on AI works are the unclear legal status, ownership issues, and proof of originality and human creativity. Based on cases related to copyright disputes over AI works, the development of jurisprudence shows a tendency towards an adaptive approach. Courts emphasize that copyright is granted to humans who play a role in the creation process.
