Abstract
The development of peer-to-peer lending services in Indonesia places the principle of digital consent as a crucial element in protecting customer personal data. However, in practice, digital consent is often granted without adequate understanding and transparency. This study aims to analyze the regulation of digital consent principles in P2P lending services and examine the challenges and obstacles to protecting customer personal data. The research method used is normative legal research with qualitative juridical analysis, which is used to examine data obtained through literature and document studies. The results show that the regulation and implementation of digital consent principles based on Law No. 27 of 2022 and the P2SK Law, P2P lending services have not been consistently applied. Many non-transparent consent practices are still found. The implementation of digital consent principles in the peerto-peer (P2P) lending sector faces challenges such as low customer understanding, one-sided standard agreements, unequal bargaining power, the use of dark patterns, and one-click approvals that make consent pseudo-consent. The obstacles in personal data protection include weak supervision, misuse of digital consent, a formalistic approach to the validity of consent, the absence of separation of consent, and difficulties in proving and enforcing the law, so that the protection of customer personal data is not optimal.
