Abstract
The development of information technology, particularly the live streaming feature on YouTube, has created a digital public space that enables the rapid and widespread dissemination of information. This situation is often exploited to convey statements that have the potential to attack a person's honor and reputation, giving rise to new legal issues in the enforcement of criminal defamation in cyberspace. The real-time nature of live streaming and the absence of prior editing pose unique challenges, particularly regarding the validity of video recordings as electronic evidence and the effectiveness of punitive approaches to prosecution, which have tended to be repressive. This study aims to analyze the position of YouTube live broadcast video recordings as the basis for reporting criminal defamation and to examine the application of restorative justice as an alternative to case resolution in the digital age. The research method used is normative legal research with a legislative and conceptual approach, supported by a literature study of primary and secondary legal materials. The results of the study show that live broadcast video recordings on the YouTube platform can be used as valid electronic evidence as long as they meet the principles of authenticity, integrity, and accountability in accordance with the provisions of the Electronic Information and Transaction Law. In addition, the application of restorative justice in defamation cases in the digital space is considered relevant and proportional because it focuses more on restoring the victim's reputation, acknowledging the perpetrator's responsibility, and creating a balance between the protection of honor and freedom of expression. This study produced normative recommendations for law enforcement officials to prioritize a restorative justice approach in handling digital media-based defamation cases.
