Abstract
Technological developments have triggered advances in online trading, making investment easier. However, poorly managed investments pose the risk of fraudulent investments that deceive the public and cause significant financial losses. This type of crime promises high returns compared to the initial capital. This study focuses on a case of online investment fraud involving Binomo affiliate Indra Kesuma, alias Indra Kenz. The defendant spread false and misleading information through YouTube videos, causing victims to suffer losses amounting to tens of billions of rupiah. Supreme Court Decision Number 2029/K/Pid.Sus/2023 serves as the basis for this study. The purpose of this study is to analyze the enforcement of criminal law and the judge's considerations in handing down the verdict in online investment fraud case No. 2029/K/Pid.Sus/2023. This study uses normative legal research with a case and legislation approach. Data collection was conducted through literature study, and data analysis used qualitative methods. The discussion of the research covers the application of Article 378 of the Criminal Code, Article 28 paragraph (1) in conjunction with Article 45A paragraph (1) of the ITE Law, and Article 3 of the Money Laundering Law. The Supreme Court Justice in Decision Number 2029 K/Pid.Sus/2023 rejected the defendant's appeal, imposing a sentence of 10 years in prison and a fine of IDR 5,000,000,000, or a subsidiary 10 months. However, this decision does not fully reflect the principle of justice due to the enormous losses suffered by the victims. The author believes that judges need to consider non-legal aspects and should impose heavier penalties, as well as focus on recovering losses for victims, in line with progressive legal theory. Maximum penalties are necessary to provide a deterrent effect, while also fulfilling the function of law as social control
