Abstract

These issues have received serious attention, with several obstacles identified, including non-compliance of menus with nutritional standards, delays in food distribution, limited menu variation across regions, and confusion among schools due to the absence of uniform technical guidelines. The Free Nutritious Meal Program (MBG) often faces difficulties in evaluation and monitoring. This study aims to examine the legal protection avaijlable to victims of food poisoning in the Free Nutritious Meal Program and to identify the legal liability (administrative, civil, or criminal sanctions) imposed on parties who are negligent in the implementation of the program. The research method employed is a normative legal approach using a statutory approach, conducted through a literature review utilizing primary, secondary, and tertiary legal materials. The results of this study indicate that: (1) legal protection for victims of food poisoning in the Free Nutritious Meal Program, according to prevailing laws and regulations, consists of two forms of legal protection, namely preventive and repressive protection; and (2) the forms of legal liability (administrative, civil, or criminal sanctions) imposed on parties negligent in the implementation of the Free Nutritious Meal Program include three types of sanctions: administrative sanctions imposed on organizing parties who violate regulations, civil liability providing compensation opportunities for harmed victims, and criminal sanctions applied as a form of legal accountability for organizers who intentionally commit harmful acts.
