Abstract
This study aims to analyze the synchronization between qawa’id fiqhiyyah (Islamic legal maxims) and the evolution of positive waqf law in Indonesia, spanning from the pre-independence era to the Reformation era. The research is motivated by the transformation of waqf regulations in Indonesia—shifting from customary law and unwritten Islamic law toward a positivized national legal system—necessitating an evaluation of the extent to which these positive laws align with the fundamental principles of Islamic law. The methodology employed is qualitative with a historical-normative approach, utilizing library research techniques. Data were gathered from secondary sources, including statutory regulations, official documents, and relevant academic literature. The analysis was conducted through a descriptive-analytical method to interpret the correlation between waqf regulations and qawa’id fiqhiyyah.The results indicate that the development of positive waqf law in Indonesia is categorized into three primary phases: The Pre-Independence Era: This period aligns with the maxim al-daruratu tubihu al-mahzurat (necessity renders prohibited things permissible), as the Muslim community navigated the constraints of colonial law while striving to maintain the principles of flexibility and the mitigation of harm.The Post-Independence Era: This phase reflects the maxims al-yaqin la yuzal bi al-shakk (certainty is not overruled by doubt) and dar’ al-mafasid muqaddam ‘ala jalb al-masalih (averting harm takes precedence over achieving benefits) through state initiatives to establish legal certainty and prevent social disorder caused by regulatory vacuums.The Reformation Era to the Present: This period is anchored in the maxim tasarruf al-imam ‘ala al-ra’iyyah manutun bi al-maslahah (the leader’s actions toward the citizens must be governed by public interest). This is evident in the productive waqf policies within Law No. 41 of 2004, Government Regulation No. 42 of 2006, and Government Regulation No. 25 of 2018, all of which prioritize the principle of public welfare.In conclusion, the process and outcomes of the positivization of waqf law in Indonesia demonstrate a robust alignment with the tenets of Islamic law within the framework of qawa’id fiqhiyyah, specifically regarding welfare, legal certainty, and justice. This research is expected to contribute to the integration of Islamic law and the national legal system in the management of waqf in Indonesia.
