Abstract

Law No. 11 of 2012 on the Criminal Justice System for Children (SPPA Law) emphasises a rehabilitative approach for children in conflict with the law. However, its application in cases of serious crimes, such as rape and murder in Palembang in 2024, has sparked debate regarding the balance between protecting child offenders and justice for the victims' families. This study aims to analyse the relevance of the UU SPPA in handling serious crimes, assess whether justice for the victims' families has been accommodated in Decision No. 50/Pid.Sus Anak/PN.Plg and Decision No. 51/Pid.Sus-Anak/PN.Plg, and review the punishment of children from an Islamic law perspective. The research method used is normative juridical with a statute approach and a case approach. Data was obtained from primary legal materials (1945 Constitution, Criminal Code, Al-Qur'an, hadith), secondary legal materials (books, journals, decisions, previous studies), and tertiary legal materials (KBBI). Data collection techniques were carried out through literature studies, with data analysis using qualitative descriptive methods with a doctrinal-inductive pattern of thinking. The results showed that the SPPA Law is still normatively relevant, as the verdict is in accordance with the law. However, its relevance is limited in substantive terms because it does not yet reflect a balance between the protection of children and justice for the families of victims. Decisions No. 50/Pid.Sus-Anak/Pn.Plg and No. 51/Pid.Sus-Anak/Pn.Plg have not been able to achieve justice for the families of victims because diversion does not apply to serious crimes and the penalties are considered too lenient. From an Islamic law perspective, the punishment of children who commit serious crimes must consider the balance between guidance and justice, in line with the principles of tadarruj and maqashid al-syariah, which emphasise the benefit and protection of human life.
