Abstract
This study aims to conduct an in-depth examination of the Mudarabah contract as one of the most prominent Sharia-based investment instruments in Islamic jurisprudence and to analyze its feasibility for application as a contractual model in Islamic insurance (ta’min shar‘i). This model is positioned as a legitimate alternative, under Islamic law, to conventional insurance, which often contains prohibited elements such as gharar (excessive uncertainty), riba (usury), and maysir (gambling). The research begins by exploring the conceptual and normative foundations of the Mudarabah contract, covering its pillars, conditions, and governing principles, followed by a discussion on adaptation mechanisms to align with the characteristics of Islamic insurance contracts. This approach is directed toward realizing the maqasid al-shariah, particularly in safeguarding wealth, upholding justice, and preventing harm. The study also presents a comparative analysis of the regulatory frameworks in positive law governing Islamic insurance, identifying areas of convergence and divergence with the rulings of Islamic jurisprudence. The focus includes the management of participants’ funds, the distribution of profits and losses among the parties, and the regulation of contractual obligations to protect rights and minimize potential disputes. The findings indicate that employing the Mudarabah contract in Islamic insurance has the potential to establish a high level of contractual fairness and to enhance trust between the parties, provided that the Sharia principles and requirements are consistently observed. The study also finds partial alignment between certain provisions of Islamic jurisprudence and positive law, though further legislative reforms are necessary to achieve complete harmony with Sharia principles. Practically, this research makes a significant contribution to enriching the literature on Sharia-compliant investment contracts while opening opportunities for the development of Islamic insurance products that are more diverse, competitive, and uphold high integrity. By integrating the insights of Islamic jurisprudence, contemporary legal frameworks, and market needs, the Mudarabah contract can serve as a contractual model that not only fulfills the requirements of Sharia but also adapts to the dynamics of the modern financial industry.
