Abstract

In cases of serious violations such as murder in Indonesia, not only are they committed by adults but also involve children. This study aims to examine the judge's considerations and the application of juvenile punishment in three cases: decisions Number: 2/Pid.Sus-Anak/2019/PN Mpw, Number: 3/Pid.Sus-Anak/2019/PN Tkn, and Number: 3/Pid.Sus-Anak/2022/PN Bnt. This study used a normative method with a legal norm approach and case studies. The results show that the judge's considerations in sentencing juvenile perpetrators of murder were appropriate, taking into account both legal and non-legal aspects, including social background and prevailing values of justice in society. Furthermore, the application of punishment to juvenile perpetrators of murder was appropriate in this case, considering the principles of justice, the best interests of the child, and the principle of ultimum remand as a last resort. However, challenges remain in achieving a balance between justice for the victim and optimal protection of the rights of juvenile perpetrators.
