Abstract

A contract sometimes encounters obstacles that can hinder the progress of a land transaction. Something can happen that results in the cancellation of the contract. This study aims to reveal the legal effects of the cancellation of a land transaction binding deed and the parties in its legal protection. A normative approach was taken to examine several legal aspects, principles, rules, doctrines and others. The study was conducted at a notary/PPAT in Boyolali Regency. Secondary data were in the form of a land transaction binding deed. Literature study and field study as data collection. Data analysis techniques used qualitative analysis. The results of the study show that: first, the Land Transaction Binding Deed (PJB) is a previous contract before the Deed of Sale and Purchase (AJB) is made. The PJB contract is to provide definite law for interested parties who have paid while the land certificate is not yet ready. The PJB contract is in the form of a notarial deed (authentic deed) and is binding (Article 1868 of the Civil Code). The cancellation of the PJB has the following impacts: (1) The contract is completed. A PJB will be void if three conditions are met: reciprocity, default, and a judge's decision (Article 1266 of the Civil Code); (2) Refund of money, compensation, and fines (Article 1267 of the Civil Code); Second, legal protection in the form of: (a) For the seller, adding a condition for payment in a fixed term; (b) For the buyer: Conditions for not being unilaterally canceled, land certificates to a third party, and a power of attorney. If the conditions for a deed of sale are met, then the transfer of authority over the land can be carried out.
