Abstract

This study aims to analyze the legal role in supporting the implementation of green banking and to examine the application of green banking principles in supporting the carbon exchange mechanism in Indonesia. The background of this research is based on the urgency of climate change mitigation, which requires the active role of the financial sector in sustainable financing. Green banking is a banking concept that integrates environmental sustainability aspects into its operations, while the carbon exchange is a carbon credit trading instrument aimed at reducing greenhouse gas emissions. Both are strategically linked in supporting the transition towards a green economy. This research uses a normative juridical approach with data sources consisting of primary, secondary, and tertiary legal materials collected through literature studies. The analysis is conducted qualitatively to examine the correlation between regulations governing green banking and the carbon exchange, including OJK Regulation No. 51/POJK.03/2017, OJK Regulation No. 14/2023, and Presidential Regulation No. 98/2021. The results of the study indicate that the legal role in green banking in Indonesia includes establishing standards, criteria, and obligations for financial service institutions to implement sustainability principles, while also encouraging the financing of projects that generate carbon credits to be traded on the carbon exchange. The application of these principles has the potential to strengthen the achievement of the Nationally Determined Contribution (NDC) target and the 2060 Net Zero Emission commitment. However, successful implementation requires regulatory harmonization, strengthened emissions verification, and increased literacy among businesses and the banking sector.
