Abstract

This study aims to analyze the legal aspects of licensing and liability of PT Global JET Express (J&T Express) in freight transport agreements using a normative juridical approach, focusing on applicable regulations such as Ministry of Transportation Regulation No. 60 of 2019 and Law No. 8 of 1999 on Consumer Protection. The findings indicate that, administratively and technically, J&T Express has fulfilled operational licensing requirements, including the possession of necessary permits and the implementation of a safety management system. However, in practice, the company’s legal responsibility to consumers reveals several issues, such as the use of standard clauses that disproportionately limit compensation and a complicated claim process that burdens consumers. These practices highlight an imbalance in bargaining power and potential violations of fairness and consumer protection principles. Common complaints include lost or damaged goods and delivery delays. Therefore, this research recommends a reformulation of service terms and conditions, improved transparency, and stronger regulatory oversight. The study contributes to the development of a more accountable and equitable freight transport system that ensures effective legal protection for consumers, especially in the context of the rapidly growing digital logistics sector.
