Abstract
This research is about sexual abuse of children, sexual abuse is included in criminal offenses that violate decency. Sexual abuse is an offense that like other offenses in general has its own offense formulation, elements, and types that affect the consequences. Likewise with child molestation, the State provides a lot of legal protection for minors to protect the rights and future of children as the next generation of the Indonesian nation. This thesis research method uses normative juridical research, namely legal research conducted by examining library materials or secondary materials. This research contains a juridical review of the crime of child abuse with the perpetrator being a child in the Karanganyar District Court. This research aims to: (1) to find out the judge's consideration in the case of the crime of child abuse with the perpetrator being a child based on decision Number: 4/Pid.Sus/2023/Pn Krg; (2) to find out the legal regulation of the crime of child abuse with the perpetrator being a child. The results showed that (1) according to the view of positive law, sexual abuse is considered as an act that violates the rights and immorality of children; (2) according to Islamic law, sexual abuse is categorized into acts that are close to adultery; (3) the consequences of the perpetrator of the crime of child sexual abuse have been attempted by the Karanganyar Panel of Judges through several policies.
