Abstract
A credit agreement does not always run smoothly, one example being non-performing loans. One of the efforts made by banks to address this issue is credit restructuring. Credit restructuring is an effort by the bank (creditor) to assist debtors who are unable to fulfill their obligations (performance). This research aims to understand the procedures for implementing credit restructuring and the obstacles encountered during the process at Bank Rakyat Indonesia, Ngawi Branch, Ahmad Yani Unit. This study employs an empirical legal research methodology, utilizing both primary and secondary data sources. Primary data were obtained through interviews with bank officials, while secondary data included laws and regulations, books, journals, and other references. The author then analyzes the interview results in conjunction with the applicable laws and regulations. The findings of this study reveal eight stages in the implementation of credit restructuring: (1) Credit Restructuring Initiative, (2) Negotiation with the Debtor, (3) Analysis and Evaluation, (4) Restructuring Application, (5) Restructuring Offer, (6) Restructuring Documentation, (7) Restructuring Agreement, and (8) Supervision or Monitoring. These eight stages comply with Articles 57–59 of the Financial Services Authority Regulation Number 40/PJOK.03/2019 concerning the Quality of Commercial Bank Assets and the Guidelines for Credit Restructuring as stipulated in the annex to the same regulation. Furthermore, the analysis and evaluation stage aligns with Article 2 of Law Number 10 of 1998, which amends Law Number 7 of 1992 concerning Banking. Obstacles encountered during the credit restructuring process at BRI Ahmad Yani Unit, Ngawi Branch, consist of two types: legal or normative obstacles and non-legal obstacles.
