Abstract

This research discusses legal issues related to the legal protection of BPJS Kesehatan patients in Indonesia’s healthcare services, specifically from the perspective of the principles of justice and benefit. The primary focus is to analyze how far the BPJS system ensures patients’ rights in a fair and beneficial manner amid the complexity of procedures and access to services. The study uses a normative juridical method with conceptual, statutory, and comparative approaches between positive law and Islamic law. The results show that although BPJS Kesehatan has contributed to improving access to healthcare, there are still significant challenges in its implementation, such as administrative bureaucracy, limited facilities, and service disparities. A comprehensive evaluation of BPJS policies and increased public legal awareness are necessary to ensure that the promised legal protection is realized substantively and in accordance with the principles of justice and utility.
