Abstract

This study aims to examine the legal policies concerning victims of cyberbullying crimes and the evidentiary process involved in such cases. The research uses a statute approach with a normative juridical method. Data sources consist of primary, secondary, and tertiary legal materials. The data collection method is legal literature study, and the data are then analyzed qualitatively. The results show that establishing strong legal regulations is crucial in addressing cybercrime, including cyberbullying. The government must act decisively in enforcing the law. Legal protection for victims is regulated under the Electronic Information and Transactions Law (ITE Law), which prohibits defamation or insults via electronic media. Victims may also refer to the Criminal Code (KUHP), specifically the articles concerning defamation and slander, to strengthen their legal efforts. Although legal instruments are already in place, victims’ willingness to report and public support play a vital role in reducing cyberbullying cases. Cyberbullying is a social media crime repeatedly committed by individuals or groups against vulnerable victims for the perpetrators' own gratification. The emergence of information technology has triggered profound changes in human conditions. The rise of social media has also created a new cultural landscape that significantly influences human thought patterns and behaviors. To ensure justice, evidence in cyberbullying cases must meet the requirement of at least two valid pieces of evidence, as stated in the Criminal Procedure Code (KUHAP). Types of evidence include written documentation, witness testimony, metadata analysis, and digital forensics to verify the authenticity of the evidence and the perpetrator’s communication.
