Abstract
The protection of the right to express opinion on social media is a crucial issue in the digital era, considering that social media is a new public space that allows the expression of opinions widely without geographical boundaries. However, this freedom faces serious challenges, especially regarding the misuse of information and legal restrictions regulated by the Electronic Information and Transaction Act (UU ITE) and Law Number 1 of 2023 concerning the New Criminal Code (KUHP). The ITE Law is often seen limiting freedom of expression through articles that regulate defamation and the spread of hoaxes, which has the potential to cause legal uncertainty and curb public participation. Meanwhile, Law Number 39 of 1999 on Human Rights emphasizes the protection of the right to opinion as a fundamental right that must be respected and protected by the state. Through a normative juridical approach, which is a legal research method carried out by examining and analyzing literature materials or secondary data related to legal protection of the right to express on social media, this study aims to analyze legal protection of freedom of expression on social media in the context of UU ITE and Law Number 1 of 2023, as well as analyzing factors that affect legal protection of freedom of opinion in people in Indonesia. The research recommends the harmonization of regulations between the ITE Law and the Criminal Code, a review of multi-interpretation articles that have the potential to curb freedom of opinion, and the strengthening of people's digital literacy. In addition, factors such as weak implementation of regulations, low digital literacy, dominance of social media platform control, and socio-political pressure also worsen the protection of these rights, therefore independent supervision of the implementation of the law and increasing transparency by the government and law enforcement officers are needed. The research results are expected to contribute to a more just legal policy and siding with the protection of human rights in the digital realm, while increasing public awareness of the importance of the right to opinion in modern democracy.
