Abstract

The analysis of the relationship between the weaknesses of the democratic system during the election period and corruption cases in Indonesia aims to identify the form of defects in the democratic system in the election that have the potential to create space for corruption among public officials and the relationship between defects in the democratic system in the election and the emergence of corruption cases from an Islamic legal perspective. The research method used is normative legal research. The results of the study show that the election system is not yet fully transparent and accountable, the high cost of politics, and the weak mechanisms of supervision and law enforcement create conditions that are vulnerable to money politics and abuse of power. The high cost of politics in the process of nominating regional heads and legislative candidates encourages candidates to seek financial support from sponsors or businessmen. Islamic law demands the existence of a syura (deliberation) and hisbah (supervision) mechanism to ensure that power is not abused and decisions are made based on justice and truth. The relationship between the defects in the democratic system in the election and the emergence of corruption is very close and mutually influential. A flawed democracy characterized by weak law enforcement, high political costs, money politics, and oligarchic dominance, becomes fertile ground for corrupt practices in accordance with the Islamic view which emphasizes the importance of justice, trustworthiness, and integrity in leadership, so that it can increase the practices of corruption, collusion, and nepotism.
