Abstract

Indonesia has a high level of biodiversity, but human activities pose a threat to wildlife. Low public awareness of the law leads to violations that are committed without malicious intent (mens rea). The case of I Nyoman Sukena is an important example of judges considering the element of intent in their verdicts. This study uses a normative juridical method with a legislative, case, and conceptual approach. Data was obtained through a literature review of primary, secondary, and tertiary legal sources. Analysis was conducted using a descriptive-qualitative approach. The study found that the actus reus element in the I Nyoman Sukena case was proven, but the mens rea element was not fulfilled because the defendant was unaware that the animals he kept were protected species. The judge considered the absence of malicious intent, social background, and limited legal awareness, and issued an acquittal (vrijspraak). The conclusion highlights the importance of applying mens rea in assessing criminal liability. In the Sukena case, although the act objectively violated the law, the absence of malicious intent resulted in the subjective requirement not being met. The judge's decision reflects a balance between legal certainty and the principle of justice, particularly for communities with limited understanding of the law.
