Abstract

Land as a vital resource in the legal state of Indonesia not only has economic value but also a legal function, where the role of mortgage rights as debt collateral demands legal certainty, especially when the mortgage certificate is lost and the consent roya deed is used as its replacement, thus creating an urgency to examine the legal status of the deed in the practice of Notaries and the Land Office in Surakarta. The purpose of this research is to determine the authority of Notaries and the National Land Agency (BPN) as well as the Land Office of Surakarta City in the making of the Consent Roya Deed; and the legal status of the Consent Roya Deed as a replacement for the lost Mortgage Certificate in Surakarta City. This research is a normative legal study using a statutory approach and descriptive-analytical type, utilizing secondary and primary data collected through literature study and interviews, and qualitatively analyzed regarding Consent Roya Deed No.01 dated 05-09-2024 and the consent roya application. The research results state that Notaries have the authority to create consent roya deeds based on the Notary Law, although not explicitly regulated, because the deed contains the statements of the parties and is recognized for its validity by the Land Office as long as it meets administrative requirements. The consent roya deed has a legal status as a replacement for the lost Mortgage Certificate, with evidentiary strength as a valid authentic deed in the roya administrative process at the Land Office.
