Abstract
The present study aims to analyse and compare the views of Ibn Taymiyyah and Ibn Baaz on the practice of tawarruq sale and purchase, and to assess its suitability in the maqasid sharia principle in the context of Islamic economics. Tawarruq sale and purchase is a prominent instrument in Islamic finance that is frequently employed to address the need for cash in a manner consistent with Islamic law. Despite the contract's validity, this practice has given rise to divergent perspectives among scholars, particularly concerning maqasid sharia. It is evident that significant insights are provided by both Ibn Taymiyyah and Ibn Baaz when reflecting on the fiqh approach to tawarruq and its relevance to the values of justice and benefit in Islamic economics. The writing method employed in this study is a qualitative method, incorporating a library research approach and comparative analysis (muqaranah). This involves referring to primary and secondary sources, including the Qur'an and Hadith, as well as books by two scholars, namely Ibn Taimiyah and Ibn Baz, classical fiqh books, scientific journals, and other supporting literature sources. The results of the analysis demonstrate that Ibn Taymiyyah places significant emphasis on the prohibition of the practice of tawarruq in circumstances where it has the potential to result in usury, particularly in the absence of an urgent need or resale at a lower price. The foundation of this approach is predicated upon the principles of purpose, intention, and long-term impact. In contrast, Ibn Baaz permits tawarruq, provided that the contract is made in accordance with the stipulated conditions and there is no hidden element of manipulation, based on the external validity of the contact
