Abstract
Electronic land certificates are a form of government efforts to realize the modernization of land services. The purpose of this research is to determine whether electronic land certificates can be categorized as authentic deeds and the validity of electronic certificates in court evidence. This research uses a normative juridical approach. It utilizes secondary data, including primary legal materials and secondary legal materials. Data collection methods are conducted through literature studies. The data analysis method uses qualitative methods to produce descriptive analytical information. The results of this study indicate that electronic land certificates cannot yet be categorized as authentic deeds because they do not comply with statutory provisions, particularly Article 1868 of the Civil Code, Article 1 Number 7, and Article 16 paragraph (1) letter m of Law Number 2 of 2014 concerning the Amendment of Law Number 30 of 2004 concerning the Position of Notary. The validity of electronic land certificates is regulated in Article 6 paragraph (2) of the Minister of ATR/KBPN Regulation Number 3 of 2023 concerning the Issuance of Electronic Documents in Registration Activities, Article 84 paragraph (3) of Government Regulation Number 18 of 2021 concerning Management Rights, Land Rights, Apartment Units, and Land Registration, as well as Article 5 paragraphs (1) and (2) of Law Number 1 of 2024 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions. Electronic land certificates are an extension of valid evidence; however, it is necessary to harmonize the provisions between Article 1868 of the Civil Code, Article 1 Number 7, and Article 16 paragraph (1) letter m of Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 concerning the Office of Notary with Article 1 Number 9 of Law Number 1 of 2024 concerning the Second Amendment to Law Number 11 of 2008 concerning Electronic Information and Transactions.
