Abstract
Indonesia's fisheries sector holds significant potential as a driver of national economic advancement. Effective and efficient management is essential to realize this potential. The defendants were proven guilty of committing a fisheries crime involving the transportation and distribution of fish without the required permits. This study aims to analyze the legal considerations made by the panel of judges in decisions Number 9/Pid.Sus-PRK/2021/PN.Plg, 10/Pid.Sus-PRK/2021/PN.Plg, and 11/Pid.Sus-PRK/2021/PN.Plg, and to examine their compliance with the principle of legality and the absolute theory of punishment. This research adopts a normative juridical approach. The entire legal process, from the indictment, evidence, prosecution, to the defense (plea), was conducted in accordance with applicable laws and regulations. The judges' legal considerations included elements such as "any person," "intentionally," and "committing, ordering, or participating in the crime." Non-legal considerations involved aggravating and mitigating factors, as well as justification and excuse defenses. The findings indicate that the panel of judges consistently applied the principle of legality and the absolute theory of punishment in adjudicating the fisheries crime case involving lobster seed cultivation.
