Abstract
This study aims to focus on describing the legal considerations made by the judge in Decision No. 354/Pid.Sus/2023/Pn Sda regarding a criminal defamation case in the form of hate speech using social media. Additionally, this study seeks to expand knowledge in the field of law, particularly criminal law and the Information and Transactions Law (ITE Law), regarding the appropriateness of the legal considerations made by the judge in Decision No. 354/Pid.Sus/2023/Pn Sda concerning the criminal case of defamation in the form of hate speech using social media. One instance of social media misuse occurred in a hate speech case in Sidoarjo, East Java. Criminal Case Decision No. 354/Pid.Sus/2023/Pn Sda states that David Advent Christi Taena, as the defendant, has been proven legally and convincingly guilty of intentionally and without rights spreading information intended to incite hatred or hostility toward individuals and/or certain groups of society based on ethnicity, religion, race, and intergroup relations (SARA). This study is based on the use of normative legal research methods or a doctrinal approach. The type of legal research applied in this study is descriptive. The Panel of Judges in Decision No. 354/Pid.Sus/2023/Pn Sda imposed criminal penalties on David Advent Christi Taena, namely the Criminal Act of Spreading Content Containing Hate Speech Against a Group Through Social Media (Instagram) with the charge of violating Article 45A paragraph (2) of Law of the Republic of Indonesia Number 19 of 2016 concerning Amendments to Law of the Republic of Indonesia Number 11 of 2008 concerning Information and Electronic Transactions in conjunction with Article 28(2) of the Republic of Indonesia Law No. 11 of 2008 on Information and Electronic Transactions, in accordance with the Prosecutor's Charges.
