Abstract
This study aims to conduct a comparative analysis between the fatwa of the National Sharia Council of the Indonesian Ulema Council (DSN-MUI) No. 05/DSN-MUI/IV/2000 on Salam sale contracts and the resolution of the International Islamic Fiqh Academy (Majma' al-Fiqh al-Islami ad-Dauli) of the Organization of Islamic Cooperation (OIC) No. 85 (2/9) concerning Salam sale and its application in the contemporary context. The Salam sale contract is one of the essential contracts in Islamic finance, commonly used as a financing tool for productive sectors. Both the DSN-MUI fatwa and the resolution of the Islamic Fiqh Academy affirm the legitimacy of Salam contracts in accordance with Islamic principles. However, there are differences in implementation and formulation, influenced by each institution’s legal approach and local context. This research employs a qualitative method through library research and comparative analysis (muqāranah). The data is sourced from official documents of both institutions, classical Islamic jurisprudence (fiqh) texts, journals, and other supporting literature. The analysis reveals a convergence in legal foundations and primary conditions of Salam contracts, but distinctions appear in aspects such as the regulation of parallel Salam, methods of execution, and considerations of maqaṣid al-shari’ah. This study underscores the importance of synergy and coordination between national and international fatwa institutions in formulating contemporary fiqh provisions, ensuring that Sharia-compliant transactions remain relevant and responsive to modern challenges.
