Abstract
Murder is an act that not only affects the individuals involved but also has broad impacts on society and the legal order. This research aims to determine whether the judge's decision in Case No. 370/Pid.B/2023/PN.Mlg is in accordance with the applicable legal sanctions and to examine it from the perspective of Islamic law. This study uses a normative juridical approach, which views law as a structured system of norms, by analyzing and utilizing secondary data in the form of Decision No. 370/Pid.B/2023/PN.Mlg as the primary source, along with secondary data such as the Indonesian Penal Code (KUHP). The judge's consideration in imposing a criminal sentence on the perpetrator of the murder in Decision No. 370/Pid.B/2023/PN.Mlg is deemed inconsistent with applicable legal provisions, as the legal evidence presented in court clearly fulfilled the elements of intent and the deliberate taking of another person’s life, further supported by the fact that the perpetrator brought a sharp weapon prior to the incident. Under Islamic law, if a person murders another, a proportionate punishment (life for life), known as Qisas, is applied.
