Abstract

The amendment to the Corruption Eradication Commission Law (UU KPK) from Law No. 30 of 2002 to Law No. 19 of 2019 was motivated by, among other things, the KPK's less effective performance and poor coordination between institutions, which has caused various controversies in the perspective of legal politics. This revision changes the status of the KPK to part of the executive. This study aims to analyze legal politics in the amendment to the KPK Law and the factors that influence it. The method used in this study is qualitative with a normative legal approach. Data were obtained through analysis of laws and regulations, Constitutional Court decisions, academic papers, and related literature. The results of the study show that the revision of the KPK Law was initiated by the Constitutional Court's decision not from any party and then became the basis for the DPR. Several factors that influence the amendment to the KPK Law include political, social, economic, cultural, international, and institutional factors. Political factors include party interests in controlling the KPK, while social factors involve public pressure on anti-corruption policies. Economic factors are related to the impact of corruption on development, while cultural factors reflect anti-corruption values in society. International factors relate to global pressure to eradicate corruption, and institutional factors reflect the relationship between law enforcement agencies in Indonesia. The conclusion of this study confirms that the revision of the KPK Law is influenced by political dynamics that have implications for the independence and effectiveness of the KPK in eradicating corruption. Therefore, it is recommended that there be a legislative review to restore the independence of the KPK and increase transparency in the formation of anti-corruption policies with wider public participation.
