Abstract

The expectation of the research is to examine law enforcement efforts and identify aspects contained in Article 56 of Law Number 39 of 2007 concerning Excise. The research utilizes normative research, with a descriptive research type. The source of this data uses secondary data. Meanwhile, the data collection method will be carried out through searching, inventorying, and reviewing secondary data, which are then analyzed using qualitative normative methods. The research findings explain that the basis for judges in deciding sentences for defendants charged with violating criminal acts in the form of distributing illegal cigarettes without excise stamps refers to evidence revealed in court and relevant legal provisions related to the case.
