Abstract

The emergence of electronic land title certificates has caused some commotion among the public. One of the concerns that arises in the community is the fear that the electronic land title certificate cannot be used as collateral for debt at the bank. Legal certainty regarding this matter is important to discuss because it also concerns the interests of creditors as the holders of the electronic landbtitle certificate as collateral for debt. The purpose of this study is to determine the position of electronic land title certificates as collateral for debt and legal protection for creditors who hold them. This study uses a normative legal approach method. The type of data used is secondary data consisting of primary legal materials and secondary legal materials. The data analysis method is guided by the qualitative method. The results of this study state that according to the Regulation of the Minister of ATR/Head of BPN No. 3 of 2023, printed electronic land title certificates can be used as collateral for debt only through mortgage rights. The legal protection obtained by creditors who hold them is legal protection as given to mortgage holders, in addition, the ministerial regulation regulates the procurement of paper with special specifications and is confidential which is used to print official copies of electronic land certificates.
