Abstract
Differences in the regulation in the legislation related to the position of the DPRD between legislative and executive powers, raise questions about the position of the DPRD in the implementation of regional government. The election of DPRD members is still carried out together with the election of DPR and DPD members, resulting in misunderstandings when the campaign season arrives, many DPRD member candidates declare themselves as legislative candidates. The method used in this study is normative juridical where the topics discussed are adjusted to the applicable legal regulations in order to obtain accurate results. The data used are secondary data, data analysis is carried out descriptively. The results of this study are as follows: The position of the DPRD based on Law No. 23 of 2014 is that the DPRD together with the Regional Head organizes Regional Government, so the DPRD and the Regional Head are regional executive bodies that have equal status. The DPRD has the function of forming regional regulations, budgets, and supervision, this is stated in Law No. 23 of 2014. The working relationship between the Regional Head and the DPRD is explained in Article 57 of Law Number 23 of 2014 which confirms that the working relationship formed between the DPRD and the Regional Head is equal. The DPRD and regional heads carry out regional government functions as regional executives.
