Abstract
This study aims to analyze the effectiveness of law enforcement against defamation in social media based on the Electronic Information and Transaction Law in terms of the principle of legal certainly and Islamic perspective. Cases of defamation on social media show that regulations already exist, but there are still obtacles in their application, such as regulation, law enforcement, and public awareness. Social media as a modern means of communication that facilitates users and provides convenience in disseminating information. The research method used is normative legal research with a statutory and conceptual approach. Data were collected from primary (Electronic Information and Transaction Law, Criminal Code), secondary (books, journal, scientific works), and tertiary (internet, encyclopedia) legal materials, as well as Islamic sources such as the Quran and Hadiht, then analyzed qualitatively. In the Islamic perspective, defamation or slander is major sin prohibited by Allah SWT and has been written in the Al-Quran and Hadith. Allah says in QS Al-Hujurat:12 that it is forbidden to backbite and spread information that damages the honor of others. The Hadith of the Prophet Muhammad SAW also says that slander is more cruel than murder (QS Al-Baqarah:191). The study found that Islamic principles such as truthfulness (shidiq), goodwill (ihsan), and responbility (mas’uliyah) can serve as an ethical foundation for social media that is in line with positive law. This study identifities that the revision of the Electronic Information and Transaction Law trough Law No. 19 of 2016 and Law No. 1 of 2024 has improved some weaknesses, such as clarifying the definition of defamation, reducing ambiguity and multiple interpretations, and emphasizing more proportional sanctions.
