Abstract

Law plays an important role in regulating social life, including providing protection for intellectual property rights such as copyright for cinematographic works. However, the rampant piracy of films through applications such as Telegram shows weaknesses in law enforcement and low public awareness of the importance of respecting copyright. This condition causes losses for filmmakers and the creative industry as a whole. This study aims to understand the legal protection available to filmmakers in Indonesia and how law enforcement is carried out in overcoming film piracy. The focus of the study refers to Law Number 28 of 2014 concerning Copyright and Law Number 19 of 2016 concerning Information and Electronic Transactions (UU ITE). The method used is a normative approach by analyzing relevant laws and regulations, theories, and legal doctrines. The data used is secondary, including laws, legal literature, and other supporting documents, which are analyzed deductively to answer the problem formulation. The results of the study indicate that Law Number 28 of 2014 provides copyright protection for filmmakers from illegal imitation, including distribution via Telegram, by maintaining the economic and moral rights of the creator. Protection is carried out preventively through regulation and blocking of pirated content, as well as repressively through law enforcement against violators. Law enforcement faces challenges due to technological advances that facilitate the spread of illegal content. In addition to the Copyright Law, the ITE Law is also an important legal basis for prosecuting the spread of pirated content digitally, with strict criminal sanctions and fines as well as dispute resolution mechanisms through litigation and non-litigation
