Abstract
The lease agreement that the parties should have done in good faith, means that they must comply with the provisions written in the agreement and carry out their respective achievements in accordance with the obligations that have been set out in the joint agreement. However, in the implementation of the lease agreement agreed upon by the parties, it often does not run as it should because one of the parties does not fulfill the achievements specified in the agreement. This situation is included in the act of default. This study aims to describe the judge's considerations in deciding the lease case in decisions Number 4 / Pdt.G / 2023 / PN Bjn and Number 38 / Pdt.G / 2023 / PN Sel and describe default in the lease from an Islamic perspective. The author uses a qualitative research method with a normative juridical approach by conducting a search for legal materials obtained through the internet media. The results of the study show that the judge's considerations in deciding the rental case in Decision Number 4/Pdt.G/2023/PN Bjn and Decision Number 38/Pdt.G/2023/PN Sel were correct and in accordance with related regulations such as the Herziene Indonesisch Reglement (HIR) and the Civil Code (KUHPerdata) and existing provisions. People who intentionally default according to the Islamic perspective are included as hypocrites. Islam is very important to keep promises and obligations.
