Abstract
This study examines the legal meaning and sanctions associated with online gambling in Indonesia, especially from the perspective of positive law and Islamic law. Although online gambling is prohibited, the gambling industry continues to grow rapidly, with many illegal sites offering various gambling activities. Online gambling is considered to violate religious, moral, and legal norms, and can harm society, especially the younger generation. This study highlights the negative impacts of online gambling, including addiction, financial loss, and social problems. Although there are regulations on regulating online gambling, the practice is still rampant and many illegal gambling sites provide a variety of games. This study emphasizes the need for effective law enforcement strategies, including the use of sophisticated technology to track and identify illegal gambling activities. This study also analyzes the effectiveness of existing legal sanctions, as outlined in the Criminal Code, in preventing individuals from engaging in online gambling. The study findings show that despite the existence of a legal framework, its enforcement remains a challenge, requiring a comprehensive approach to protect against the negative impacts of online gambling on society. From an Islamic legal perspective, gambling is considered to be included in the category of khamr even though it is not specifically mentioned in the Qur'an or Hadith. According to Islamic law, gambling is included in khamr, can be punished with a sentence of 40-80 times, and the death penalty is applied if the violation is repeated.
