Abstract

Trademark legal protection is a legal effort to protect the trademark, avoid trademark infringement and obtain executive rights. Trademark regulations are regulated in Law No.20 of 2016 on Trademarks and Geographical Indications. Serabi Notosuman has been doing trademark registration since 2003 in its implementation whether in accordance with the regulations of Serabi Notososuman trademark protection and for the effectiveness of Serabi Notosuman Trademark rules. In this research, the research method used is empirical juridical which examines the law that applies and occurs in the city of Surakarta, especially Serabi Notosuman. This research shows how the regulation of trademark protection in Indonesia through preventive protection and repressive protection. The application of legal protection of trademark in the city of Surakarta study of Serabi Notosuman has not been effective because there are elements of legal effectiveness that have not been fulfilled.
