Abstract

This study examines the urgency of a constitutional review of the law on the age limit for presidential and vice presidential candidates after the Constitutional Court (MK) Decision Number 90/PUU-XXI/2023. The background of this study is based on the dynamics of Indonesian politics that increasingly demand the inclusivity of the younger generation in national leadership, while the existing age limit is considered to hinder political participation. The objectives of the study are to analyze the impact of the Constitutional Court's decision on the law, evaluate the need for a constitutional review, and review the decision from a siyasah (Islamic politics) perspective. The research method uses a qualitative approach with analysis of legal documents, Constitutional Court decisions, and related literature. The results of the study show that the Constitutional Court's decision opens up opportunities for the younger generation but raises controversy related to conflicts of interest and legal uncertainty. These findings indicate the need for systemic reform in the supervision of the Constitutional Court and legal harmonization to ensure justice and legal certainty. In conclusion, this study emphasizes the importance of maintaining the integrity of the judicial institution and suggests further research to explore the socio-political impact of the Constitutional Court's decision.
