Abstract

Theft is a criminal act against property regulated in the Criminal Code Book Two Chapter XXII concerning crimes against property starting from Article 362 to Article 367 of the Criminal Code. Restorative justice is the settlement of a case that prioritizes an agreement between two parties, namely the victim and the perpetrator, to seek the best results that benefit both parties and prioritize justice. This study aims to provide an explanation of the settlement of criminal cases through Restorative Justice for perpetrators of motor vehicle theft at the investigation stage in Pati Regency, using the case approach method and the analytical approach, with the type of research using research obtained through direct interviews at the Pati City Police Chief and the Pati City Police Resort, which is sourced from primary and secondary legal data, using data collection methods through literature studies. The results of the study indicate that the settlement of criminal cases through Restorative Justice for perpetrators of motor vehicle theft at the investigation stage in Pati Regency is in accordance with PERKAP No. 8 of 2021 concerning Handling of Criminal Acts Based on Restorative Justice, PERJA No. 15 of 2020 concerning Termination of Prosecution Based on Restorative Justice, and PERMA No. 1 of 2024 concerning Guidelines for Trying Criminal Cases Based on Restorative Justice.
