Abstract

The purpose of this study is to determine the punishment for perpetrators of murder under the influence of alcohol from the perspective of positive law and Islamic law. One of the murder cases that has been decided by the Panel of Appeal Judges in Court Decision Number 54 / PID / 2020 / PT KPG. Jener Beny Nggeon was legally proven to have committed the crime of murder against Maks Robin Mesakh. The defendant slashed the victim while under the influence of alcohol which caused Jener Beny Nggeon to become aggressive. The research method used is a juridical-normative study. The judge in imposing a sentence, has juridical and non-juridical considerations which are divided into sociological and philosophical considerations so that he sentenced the defendant to 12 (twelve) years in prison because he was proven to have violated Article 338 of the Criminal Code concerning the deliberate deprivation of another person's life. In Islamic law, the punishment for murder is qishash or diyat, while the punishment for someone who drinks alcohol is caning. The punishment carried out by the Panel of Appeal Judges is in accordance with the provisions of the laws and regulations. In Islamic law, perpetrators of murder under the influence of alcohol can be punished by flogging and qishsash or diyat punishment.
