Abstract

Although Indonesia has anti-SLAPP regulations, there are still many environmental fighters who are criminalized. This study discusses the guarantee of legal protection for environmental defenders from criminal prosecutions, the application of legal protection against environmental defenders from criminal prosecutions, and the application of legal protection against environmental defenders from criminal prosecutions reviewed from Islamic law. This writing uses a type of normative legal research or doctrinal legal research, which uses a statute approach method. This study finds: First, the guarantee of legal protection for environmental defenders includes Article 66 of Law Number 32 of 2009 concerning Environmental Protection and Management, Regulation of the Minister of Environment and Forestry Number 10 of 2024 concerning Legal Protection of People Who Fight for the Right to a Good and Healthy Environment. Second, the implementation of legal protection has not been optimally applied from previous cases. Third, the application of Islamic law is not regulated specifically, but in Islamic law humans are required to protect the environment.
