Abstract

The development of Artificial Intelligence (AI) technology has brought new legal challenges, one of which is the misuse of deepfakes in online gambling promotions. Deepfake allows the manipulation of a person's face without permission, which can harm the victim legally and socially. This research aims to understand how deepfake AI is used in online gambling promotions, analyze legal policies against its misuse, and examine legal protection for victims from an Islamic perspective. The method used is normative legal research with a descriptive approach, based on Law Number 1 of 2024 concerning ITE, Law Number 27 of 2022 concerning Personal Data Protection, Law Number 31 of 2014 concerning Witness and Victim Protection, and Circular Letter of the Minister of Communication and Information Number 9 of 2023 concerning Ethics of Artificial Intelligence. The results show that AI in the form of deepfake in online gambling promotion is used with face swappig, lip syncing, and deep video portrait techniques. From a legal perspective, the existing regulations still have gaps in victim protection. Meanwhile, the Islamic perspective emphasizes the prohibition of manipulation that harms individuals. Therefore, clearer regulations and a stronger legal protection system are needed for deepfake victims in the digital world.
