Abstract

Children have great potential to continue the nation's struggle in the current era of progress. However, progress has various impacts, both positive and negative. Unfortunately, negative behavior that deviates from the norm does not only occur in adults, but has also begun to spread to children. Based on research reports published by the Directorate General of Corrections, Ministry of Law and Human Rights, cases of violations committed by children continue to increase every year. The legal process applied to cases of child crimes also differs from the legal process in general, because children who are perpetrators of crimes and violations are not yet considered legally competent. The legal process for children in conflict with the law (ABH) must be carried out in accordance with Law Number 11 of 2012 concerning the Juvenile Justice System (SPPA), starting from the investigation stage, diversion, detention, until the issuance of the Police SP3 or termination of the investigation. However, in practice, obstacles are often encountered even though they have been carried out in accordance with existing regulations. This study aims to determine the implementation of the Termination of Investigation with Child Perpetrators in Lamongan. The results of this study are that the Termination of Investigation or issuance of a Police SP3 will be carried out when the diversion efforts are successful and a peace agreement is reached.
