Abstract

This research aims to analyze the implementation of the right of victims of sexual violence to obtain assistance in the judicial process and identify the obstacles faced in its implementation in the jurisdiction of the Purwodadi District Court. The background of this research is based on the importance of assistance as part of protection and recovery for victims, as guaranteed in various national legal instruments. Assistance for victims of sexual violence has an important role in ensuring a fair and pro-victim judicial process. The research method used is empirical juridical with a qualitative approach. Data was collected through interviews with judges and advocates handling sexual violence cases, as well as the study of relevant legal documents. The results showed that the implementation of the right to assistance at the Purwodadi District Court still faces various obstacles, including limited resources for assistance agencies, lack of understanding of law enforcement officials of the urgency of assistance, and social and cultural factors that affect the courage of victims in accessing their rights. Therefore, synergy between law enforcement officials, assistance agencies, and community organizations is needed to strengthen assistance mechanisms, increase the capacity of officials, and expand victims' access to legal aid and psychosocial services.
