Abstract
Islamic financial transactions, particularly sukuk (Islamic bonds), face challenges related to the use of workarounds (hila) that may lead to the circumvention of Sharia rulings, sparking debate among scholars about their legitimacy. This research aims to explore the types of hila present in the fatwas issued by Indonesia's National Sharia Council and assess their compliance with Islamic law. The study employs a descriptive-analytical library methodology, analyzing fatwas and scholarly opinions related to sukuk. The findings reveal that the hila used involve only superficial changes and do not adhere to the necessary Sharia principles, rendering sukuk similar in essence to interest-bearing bonds. The study recommends conducting in-depth research on hila in Islamic financial transactions and developing clear frameworks for implementing permissible hila, thereby enhancing the effectiveness of the Islamic financial system and ensuring its alignment with Sharia principles.
