Abstract

This research is aimed at identifying and analyzing the immunity rights strategy implemented by PT. Pawnshopping of pawned goods which are suspected to be the proceeds of the crime of theft. Pawning is a right owned by PT. Pawnshopping of movable goods handed over by customers or authorized parties, as a form of collateral for the loan facilities provided. The research method used is qualitative normative juridical with a focus on analysis of official documents, juridical reviews, and interviews with PT staff. Pawnshop. So it was found that PT. Pegadaian has adapted legal regulations such as Article 1977 of the Civil Code, financial services authority regulation number 31/pojk.05/2016, and internal company regulations to determine the ownership status of pawned goods. Apart from that, they also use comprehensive SOPs to verify the origin of goods. This research suggests PT. Pawnshops must continue to improve and tighten their procedures for accepting pawned goods to avoid potential legal problems.
