Abstract

This research examines the effectiveness of the role of the National Land Agency (BPN) as a mediator in resolving land disputes. This research uses an empirical juridical approach. The aim is to identify various factors that become obstacles for BPN Surakarta in carrying out its mediation function. The results of the research show that the implementation of mediation at BPN Surakarta has not been effective, which can be seen from the fact that there are still cases and disputes that have not been resolved through the mediation mechanism. Factors that influence the effectiveness of mediation include legal substance, legal structure, culture and level of legal awareness in the community, as well as the availability of facilities and infrastructure.
