Abstract

The crime of abuse is a serious issue that is developing in Indonesia. The case of abuse that resulted in death by Abdi Aprizal Sheenan attracted the attention of the Indonesian people because the abuse that occurred in Ambon City resulted in the victim's death. The judge's considerations in deciding this case reflect juridical, sociological and philosophical values. The judge considers the elements of the crime charged by the public prosecutor and pays attention to the aggravating and mitigating circumstances of the defendant. In the decision-making process, the judge evaluates all the facts and evidence and upholds justice.
