Abstract

One of the impacts of the development of the era is the emergence of children as perpetrators of digital crimes or cybercrime. As a child perpetrator of a crime, the child still has rights that must be fulfilled and one of the proposed solutions that takes into account children's rights is restorative justice. The formulation of the problem that will be studied is how to regulate restorative justice for child perpetrators of cybercrime in Indonesia and whether restorative justice can fulfill the rights of children as perpetrators of cybercrime in Indonesia. This paper aims to find out and understand how regulations relate to restorative justice for child perpetrators of cybercrime and to find out whether restorative justice can fulfill the rights of children as perpetrators of cybercrime. This study uses a normative juridical legal research method. The results of this study are that restorative justice is regulated in Law Number 11 of 2012 concerning the Juvenile Criminal Justice System and Supreme Court Regulation Number 4 of 2014 concerning Guidelines for the Implementation of Diversion in the Juvenile Criminal Justice System and restorative justice can fulfill the rights of children as perpetrators of criminal acts. The increasing number of cybercrime cases involving children requires special regulations and procedures for implementing diversion for children who commit cyber crimes and in implementing this diversion, attention must be paid to ensuring that every child's rights as a perpetrator of a crime are truly fulfilled.
